CHINA TRADE DISRUPTION

The Department of Agriculture, Water and the Environment will continue to provide certification for goods that meet the requirements of the Export Control Act. Exporters/export registered establishments are advised that some recent shipments have been delayed on entry into China, leading to commercial losses.

While the department will continue to facilitate market access and seek to ensure importing country requirements are up to date and accurate, the department encourages exporters to fully consider their own risk and potential losses. 

Exporters should ensure that they have independently confirmed relevant importing country requirements. Exporters are urged to seek advice from importers on potential for disruption to the clearance of their shipment - refer HERE
RELAXATION OF VICTORIAN COVID-19 RESTRICTIONS

A tremendous result over the last couple of weeks in Victoria has seen COVID-19 numbers come down significantly and has resulted in the Victorian Premier announcing a further relaxation of restrictions. The Premier's press release from Sunday 8 November 2020 is available HERE and a summary of revised statewide restrictions available HERE

ACCC STEVEDORING MONITORING REVIEW

FTA / APSA welcome the Container stevedoring monitoring report 2019-20 released yesterday, 4 November 2020.

The report clearly supports our advocacy addressing stevedore-imposed Infrastructure Surcharges and shipping line imposed Port Botany Container Surcharges - a summary of key findings and FTA/APSA commentary is available HERE
DIRECTPAY: A NEW OPTIONAL PAYMENT SOLUTION BY 1-STOP

DirectPay will allow Cargo Owners & Freight Forwarders the option to pay DP World's Terminal Access Charge and Patrick's Landside Charge prior to the container being received or released from the terminal. Where DirectPay is used by Cargo Owners the Transport Operators will no longer need to make payment - refer HERE
PATRICK CHAIN OF RESPONSIBILITY INITIATIVE

Patrick Terminals has launched an innovative weighing solution to help drive safety across the container handling sector. Mis-declared containers create potential safety risks throughout the supply chain from transport companies to terminal operators and shipping lines. This new weighing solution, Pondus, will help identify mis-declared weights by statistically sampling containers for weighing and then automatically notifying customers of weight discrepancies (+/- 1t) allowing parties to better meet their Chain of Responsibility obligations - refer HERE
SYDNEY EMPTY CONTAINER PARK DEVELOPMENTS

FTA is a member of the Empty Container Park Working Group (ECWG) established by Transport for NSW (TfNSW) in August 2020 to address the issues impacting Sydney empty container parks (ECPs). The issues were to be separated into short and long-term solutions.Update available - refer HERE
DRAFT FOR CONSULTATION - PACIFIC AGREEMENT FOR CLOSER ECONOMIC RELATIONSHIP (PACER) PLUS

This guide explains how to determine whether goods that are imported to Australia are eligible for preferential rates of customs duty under PACER Plus in accordance with the Customs Act 1901 and the PACER Plus rules of origin, once it has entered into force - refer HERE

STAKEHOLDER CONSULTATION: REVIEW OF AUSTRALIA'S MATURATION REQUIREMENTS FOR IMPORTED ALCOHOL

The Australian Border Force (ABF) is reviewing Australia's alcohol maturation requirements under section105A of the Customs Act 1901 (Customs Act).  Submissions are due by Wednesday 18 November to the ABF. ABF COMMISSIONER - UPDATE ON EMERGING REFORMS

Paul Zalai (Director FTA and Secretariat APSA) yesterday was privileged to interview Michael Outram APM (Australian Border Force Commissioner) and Ineke Redmond (Assistant Secretary, Customs and Border Modernisation) - recording available by registering HERE
CUSTOMS COMPLIANCE UPDATE

The October 2020 Goods Compliance Update has been released by the ABF.  Russell Wiese (Principal, Hunt & Hunt Lawyers) will TODAY (12PM AEDT)  provide commentary on the key customs compliance aspects of the report including:
  1. compliance, audit and infringement notice trends;
  2. modern slavery reporting requirements for freight forwarders and customs brokers;
  3. expectations of customs brokers when completing declarations;
  4. customs broker licensing issues;
  5. subcontracting of customs brokerage services
Russell will also provide an update on the new dumping duty rates applying to Chinese aluminium extrusions and further guidance from the Anti-Dumping Commission as to what goods are covered by the dumping duties.

FTA has received the attached information from the Ozone and Air Quality Branch at the Department of Agriculture, Water and the Environment .

The information is provided to assist customs brokers with implementing compliance procedures for the transitional provisions in the Product Emissions Standards legislation.

DIPLOMA OF CUSTOMS BROKING - TLI50816

The Diploma is accepted by the National Customs Brokers Licensing Advisory Committee (NCBLAC) as the pre-requisite course for those seeking to become licensed Customs Brokers in Australia.

CPD - BORDER COMPLIANCE PROGRAM 

The revised dates for our events fall within the 2020/2021 customs broker licensing period (1 April 2020 to  31 March 2021) and will continue to provide 24 CPD points. 6 additional CPD points will need to be obtained in Stream A.
