SINGAPORE SHIPPING COMPETITION REVIEW
Last Friday evening (local time) we had engagement on the Singapore's Competition (Block Exemption for Liner Shipping Agreements) Order that exempts certain types of liner shipping agreements from the prohibition against anti-competitive agreements under specified conditions and obligations.

Importantly, prior to 31 Dec 2021, the Competition Consumer Commission Singapore (CCCS) will make a recommendation to the Minister for Trade and Industry on whether to extend the BEO with the same or amended conditions, or not to extend the BEO. MEETING THE COMMISSIONER OF THE ANTI-DUMPING COMMISSION
We are honoured to be an ongoing member of the International Trade Remedies Forum on which we are represented by Russell Wiese of Customs and Global Trade Law

Sal Milici (Head of Border and Biosecurity - FTA/APSA) and Russell Wiese last week accepted an invitation to meet with Bradley Armstrong (as the newly appointed Commissioner of the Anti-Dumping Commission) to discuss how the forum can continue to provide an opportunity for key users of the anti-dumping system to advise the Government on the operation and improvements to Australia's anti-dumping legislation.

MEETING THE MINISTER - DISCUSSING REFORMS
We were privileged last week to have another extremely engaging meeting with the Hon Melissa Horne (Minister for Ports) and Victorian government executives discussing rail initiatives and a focus on stevedore-imposed Terminal Access Charges - we look forward to testing the Voluntary Port of Melbourne Performance Model (VPPM) in terms of the recently proposed DP World Australia fee increases.

VICTORIAN REGIONAL ABF MEETING
Last week Sal Milici (FTA / APSA) attended the Australian Border Force Victoria Regional Engagement - summary of main items below:.
  • An update was provided including the increased presence of ABF officers in CTOs and Sec 77G Depots, largely as a result of staff redeployment away from airports due to the closure of international borders.
  • Challenges from mode shift due to air cargo reduction.  Saw large increase in sea cargo shipments with 40,000plus individual shipments in one seas container.
  • Staff changes at the ABF include the appointment of Vanessa Holben as Group Manager Customs - Deputy Comptroller-General; Phil Brezzo as Assistant Commissioner South and Enforcement; 
  • Malcolm Skene as Group Manager Industry and Border Systems; and Malcolm Hollis as Inspector Supply Chain
The main message delivered was  the three areas that the ABF will  focus on in 2021

WITHDRAWAL OF PORT BOTANY CONGESTION SURCHARGES

Following our recent advocacy calling for an end to the Port Botany Congestion Surcharges, we are delighted to report that multiple shipping lines (Hamburg Sud, Maersk, Hapag Lloyd, ANL CMA CGM, MSC, Pacific International Lines & TS Lines) have responded acknowledging the improved operational conditions and termination of the surcharge. We thank these lines and others who we have been in contact with over the last three weeks for their open and positive engagement.

OUT AND ABOUT - PORT OF BRISBANE
Following our participation at last week's 'Port Landside Logistics Forum', ACFS provided a practical operational perspective to assist in our assessment of downstream implications for FTA / APSA members
Importantly, the LLF addressed HPV vehicles fees, Pondus weighing, B Triple trials, trade update and shipping line EDI messaging to empty container parks - an excellent industry engagement forum chaired by the Port of Brisbane allowing stakeholders to share perspectives and providing opportunities for reform.

TRAINING 
SECTION 77G DEPOT

Notice 2019/27 (condition 28) states Section 77G Deport licence holders must provide adequate training to make staff aware of their obligations in dealing with goods subject to the control of Customs.

CONTENT - the Section 77G Depots - Obligations Course provides operational staff with practical learning outcomes to be able to complete day to day activities with confidence that they are compliant with statutory requirements.

FREQUENCY - we recommended that staff complete this course at induction and at a minimum, review annually to remain up to date with regulatory requirements.

COST - $48 (further discounts apply for FTA members)

APPROVED ARRANGEMENTS

Approved Arrangements, previously known as Quarantine Approved Premises (QAPs) and Compliance Agreements, are voluntary arrangements entered into with the Department of Agriculture, Water and the Environment.

These arrangements currently allow operators to manage biosecurity risks and/or perform the documentary assessment of goods in accordance with departmental requirements, using their own sites, facilities, equipment and people, and without constant supervision by the department and with occasional compliance monitoring or auditing.

CONTENT - to secure an Approved Arrangement (AA) accreditation, staff are required to undertake the prescribed training course containing the following two subjects:

  • Biosecurity Awareness - provides an introduction to biosecurity in Australia and prepares staff to recognise the biosecurity risks and how these are addressed by the key stakeholders, including the department.
  • Approved Arrangement Accreditation for AA Accredited Persons - provides the skills and knowledge required for staff to undertake their role as an Accredited Person within an AA - in this course, staff will be introduced to the requirements for Classes 1 to 8 and 10 to 14 AAs, and responsibilities in identifying and reducing biosecurity risks at AA sites.

FREQUENCY- We recommended that staff complete this course at induction and at a minimum, review annually to remain up to date with regulatory requirements.
