AUSTRALIAN SHIPPERS CRY FOUL AS LINES PRESSURE FORWARDERS TO DIVULGE CLIENT DATA

Paul Zalai, director and co-founder of the Freight & Trade Alliance (FTA), a member of the Australian Peak Shippers Association secretariat and a director of the Global Shippers' Forum (GSF) believes the threat from the carriers is real.

"Clearly there is a threat faced by all in the Australian supply chain, with an increased trend in vertical integration by shipping lines, stevedores and the like. While disruption to international trade logistics is inevitable, our increased focus will be to ensure all activity is conducted in compliance with Australian law."

SURVEY - ACCC STEVEDORE MONITORING / NATIONAL FREIGHT & SUPPLY CHAIN
To assist their understanding of the industry for the next Container Stevedoring Monitoring Report, the ACCC has decided to conduct surveys with market participants across the entire freight supply chain. The surveys will be seeking views on the key issues including rising costs in the freight supply chain and changes in both the shipping and stevedore industries.

FEDERAL COURT DECISION FOR PORT OF NEWCASTLE
Whilst the decision by Justice Jargot in the Federal Court case brought by the Australian Competition & Commission (ACCC) against NSW Ports on the face of it does not bode well for the Port of Newcastle, it is clear from the response by Craig Carmody, CEO - Port of Newcastle, that they are not going to let the matter rest.

"We know there is appetite and support for a container terminal in Newcastle from NSW and international suppliers. Development of another container terminal in NSW, even whilst Port Botany still has capacity, would provide viable alternative and more cost-effective export routes for regional NSW suppliers, increasing their competitiveness and enabling Port of Newcastle to contribute even more to the State's economy"
Commenary from Marka Calfas, as a part of the NSW Ports CEO Update July 2021 "We welcomed the Federal Court of Australia's dismissal of all claims brought against NSW Ports by the Australian Competition and Consumer Commission (ACCC) and its finding that the Port Commitment Deeds did not have the purpose or likely effect of substantially lessening competition.

The judgment supports the State's container port strategy, which has identified the most effective use of investment and efficiency of the freight task in NSW is best served by utilising Port Botany's capacity first, followed by Port Kembla and only then Port of Newcastle.  We will continue to focus on ensuring these key trade gateways deliver efficiently and sustainably for the people and businesses of NSW."
