CHEERS TO A LEGEND : VALE - BRIAN STOCKWELL
The industry lost a legend last week. Stockwell International lost its original founder, Brian Stockwell. In his 50th year of business, at age 78, Brian Stockwell passed with his family by his side.His legacy will live on through his family and the Stockwell name.

Background
IFAM continues to be a targeted, temporary emergency measure and businesses need to use the next six months to adjust to the ongoing impact of the COVID-19 pandemic on international air transport. This includes developing, where possible, alternative transport pathways, packaging, product and distribution options which take into account enduring higher airfreight costs.

ROAD AND RAIL BRIDGES IN FREMANTLE TO BE REALIGNED

Fremantle Ports has welcomed the Western Australian Government's announcement this week of a new alignment of road and rail bridges to replace the ageing Fremantle Traffic Bridge.

In addition to a new traffic bridge, a new rail bridge will be built east of the current rail bridge with both rail bridges operational.

Fremantle Ports CEO Michael Parker says "Separate rail bridges will enable Fremantle Ports to reach the State Government target of 30% of containers on rail, even while the number of containers handled in the Fremantle Inner Harbour continues to grow" -  READ MORE

REVIEW OF THE POLICY FRAMEWORK & LEGISLATIVE REQUIREMENTS FOR THE IMPORTATION AND EXPORTATION OF TEMPERATURE CONTROLLED CONTAINER UNITS (TCCUS)
TARIFF CONCESSION ORDERS - REQUIREMENTS OF A VALID APPLICATION
Even with the rise of free trade agreements, TCOs remain an important tool to manage customs duty.  This will become more important as the Government has announced a future reform whereby goods covered by a TCO will be automatically exempt from dumping duty.

A recent case examined the requirements for a valid TCO application such as the inquiries that need to be made and whether the TCO describes goods by their end use.  The case contains useful guidance for customs brokers that lodge TCO applications.  CGT Law's commentary on the case can be found HERE.
DOES THE TCO APPLY?
Having a TCO made is only half the challenge.  Whether or not a TCO will apply to a particular import is often a difficult question.  The issue will depend on the tariff classification of the imported goods compared to the tariff classification to which the TCO is keyed. 

If the classifications match, the next issue is whether the TCO completely describes the imported goods.  This involves challenging issues regarding the scope of the TCO wording and the identification of the imported goods. CGT Law's commentary on the application of TCOs can be found HERE.
