APSA CONFERENCE 2021/22

As determined at the recent Australian Peak Shippers Association (APSA) Annual General Meeting, it was agreed to the 2021/22 conference has been postponed to Tuesday 22 and Wednesday 23 February 2022, Wagga Wagga, NSW.

BORDER & BIOSECURITY TO INCREASE INSPECTION RATES - NEW STREAMLINED CARGO INTERVENTION MODEL
 
FTA/APSA representatives have been briefed on a suite of initiatives the Australian Border Force (ABF) is leading for the Government's trade reform agenda with a prominent focus on the development of the Simplified Trade System.

Last week, we also received initial advice of new commissioned work by the ABF to design a new cargo intervention model in collaboration with the Department of Agriculture, Water and the Environment (DAWE).
 
We have been advised the Government has asked the ABF/DAWE to increase inspection rates of inbound sea and air cargo.

Importantly, the ABF has acknowledged the current operating model does not allow for increased inspection rates without impact to industry, and therefore seek to work with FTA/APSA and other industry representative groups to develop a new model that is more efficient and based on contemporary technology, automation, earlier intervention and embedding processes and technology in the overall supply chain.

BIOSECURITY AMENDMENT (ENHANCED RISK MANAGEMENT) BILL 2021
 
The Senate Rural and Regional Affairs and Transport Legislation Committee's current inquiry is due for report on 14 October 2021.
 
The Biosecurity Amendment (Enhanced Risk Management) Bill would amend the Biosecurity Act 2015 to enhance the ability to manage the risk of pests and diseases entering, emerging, establishing or spreading in Australian territory and causing harm to animal, plant and human health, the environment and the economy. It would strengthen the management of biosecurity risks posed by maritime and aviation arrivals, improve the efficiency and effectiveness of the administration of the Biosecurity Act, and increase a range of civil and criminal penalties to deter non-compliance and provide proportionate penalties.

PUBLIC HEARING - PARLIAMENTARY INQUIRY INTO EXPANDING THE CPTPP
 
Following our joint submission, CGT Law and Freight & Trade Alliance (FTA) have accepted an invitation from the Trade Sub-Committee of the Australian Parliament's Joint Standing Committee on Foreign Affairs, Defence and Trade, to participate in a public hearing on Thursday 30 September at 3:30 pm AEST to share views on expanding the membership of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

"Thank you also for your submission to the inquiry, the sub-committee is interested in the latest developments on the merits of expanding the membership of the CPTPP for Australia, and especially any positives or ramifications for Australia and improving its trade relations with the likes of the China, United Kingdom, United States, South Korea, and other interested nations or economies such as Taiwan."

The Committee shall examine the potential new members of the CPTPP and the case for their accession based on Australia's national interests. The Committee shall have particular regard to:
  • the opportunity for freer trade between Australia and potential new members;
  • the merit of the CPTPP as the vehicle to realise freer trade opportunities;
  • issues related to expanding and improving market access;
  • the impact of other members committing to similar high standards;
  • issues relevant to the values, rules and norms of the CPTPP;
  • the role of the CPTPP as a vehicle for economic collaboration and cooperation; and
  • any other related matters.

AUSTRALIA'S FOREIGN AFFAIRS POLICY AND ITS POTENTIAL IMPACT ON TRADE AGREEMENTS

The announcement of the AUKUS Alliance comes at a time when Australia is negotiating a free trade agreement with the EU and China has requested to join the Trans-Pacific Partnership.  AUKUS does not occur in a vacuum.  Trust has been broken with France and China sees the action as hostile.

ESC PUBLIC SUBMISSIONS AND QUEENS COUNSEL ADVICE FOR INQUIRY INTO PORT OF MELBOURNE COMPLIANCE WITH THE PRICING ORDER 2021

The Victorian Essential Services Commission (ESC) last week released the summary of their public engagement process and the key themes heard throughout the 12 week consultation period between 10 June and 3 September 2021.
 
The Freight & Trade Alliance (FTA) and other public submissions (and the engagement summary) are now available HERE under the resources tab .
 
A number of stakeholders raised issues about the extent to which the preparation of, and matters addressed in, the Port's 2021-22 Tariff Compliance Statement, are matters that fall within the scope of this inquiry. In particular, whether the forecast capital expenditure related to the Webb Dock East Expansion Project included in the capital base of the Tariff Compliance Statement for the purposes of setting prescribed services tariffs for the 2021-22 financial year, is a matter that comes within the scope of this inquiry.
 
The commission has taken Queen's Counsel advice on this. Based on the advice, the ESC has concluded that it is not a matter relevant to this inquiry. This matter will be considered in the ESC next inquiry. A copy of the advice is available HERE.

VICTORIAN COMMERCIAL PORTS STRATEGY

The Victorian Government is developing a new?Victorian Commercial Ports Strategy?as a key response to the?Independent Review of the Victorian Ports System, responding to industry's feedback for a state-wide vision for the commercial ports sector. 
 
The new strategy will further define the government's stewardship role, outlining the key steps in ensuring the future of Victoria's commercial ports.?

SHIPPING COMPETITION REFORM - AUSTRALIA'S ROLE IN INTERNATIONAL ADVOCACY ACTIVITY

As members would be aware, the Australian Peak Shippers Association (APSA) is Australia's representative on the Global Shippers Forum (GSF). Furthermore, I have a privileged role as Secretariat to APSA and as a board director on GSF.
 
In partnership with other GSF members, (being "shipper" importer / exporter associations), much intelligence, experience and knowledge is being shared in terms of dealing with international shipping lines and related national competition laws.
