REPORTING SUSPICIOUS BEHAVOIUR TO THE ACCC

Yesterday (8 November 2021), FTA/APSA joined Shipping Australia, stevedores and a small select group of industry representatives in a meeting with government agencies led by officials from Prime Minister & Cabinet. FTA/APSA reiterated the following deliverables as being achievable via government intervention including a need for: waterfront industrial relations reform, revision of competition law protections provided to international shipping lines (including repeal of Part X of the Competition and Consumer Act), regulation of minimum notification periods for surcharges / freight rate increases (suggested benchmark being 30 days as per the USA), protections against unfair shipping line imposed container detention practices and termination of exorbitant terminal access charges imposed by stevedores and empty container parks.

DCN - PART X OF THE COMPETITION AND CONSUMER ACT SHOULD BE REPEALED: ACCC

Australian Peak Shippers Association secretariat Paul Zalai said he supports the views that the ACCC put forward on Part X. He said one of two things should happen: 

"One is that we either remove all protections for international shipping lines; that shouldn't prevent them from continuing their vessel sharing arrangements or alliances, it just means that they would have to do so in compliance with Australian competition law without the protections that Part X currently offers. And if they were found non-compliant, then they would feel the full weight of the regulator for any anti-competitive practices," he said. 

"The other position would be that if the federal government decides that a level of protection is required for the international shipping lines, then we would say it would be appropriate to create the role for a federal maritime regulator, or the ACCC itself, to administer it, rather than relying on an industry association to play the policeman role."

PORT OF MELBOURNE RELEASE TENANCY CUSTOMER CHARTER 
Port of Melbourne (PoM) has released a new Tenancy Customer Charter which seeks to improve rent pricing clarity and has been designed to address the recommendations from the Essential Services Commission (ESC), which were outlined in their Market Rent Inquiry report in August 2020.
 
The Charter is understood to explains the rights and responsibilities of the PoM, tenants, and prospective tenants, as well as detailing the processes that apply to lease negotiations and agreements.
 
It will apply to both new leases and existing leases, which were negotiated and entered into after the port was privatised.

Patrick Terminals has yesterday (8 November 2021) lodged an application with the Fair Work Commission (FWC) seeking to terminate industrial action by the Maritime Union of Australia (MUA) at its four terminals - READ MORE
ADVOCACY UPDATE - BIOSECURITY

It has become evident as a part of a series of bi-lateral meetings between FTA and departmental executives, that a myriad of factors are generating the root cause(s) of problems, highlighting  a need for a broader over-haul of outdated practices with labour-intensive processing of documents to be replaced with more efficient data transfers, facilitation via industry self-assessment (including increased utilisation and expansion of Automatic Entry Processing) and modernised electronic profiling.

FTA escalated advocacy for such reform yesterday (8 November 2021) in another engagement with departmental executive and as a part of our panel involvement in Biosecurity Futures led by the Hon David Littleproud (Minister for Agriculture and Northern Australia / Deputy Leader of the National Party):

  • utilisation of flexibility offered within the new Biosecurity Act (including Approved Arrangement capabilities);
  • an enormous injection of funding received by the department in the last Federal Budget; and
  • a Federal Government mandate for efficiencies (reduction of red-tape) as a part of the emerging Simplified Trade System (STS) reform and Regulatory Sandpit initiative.
Importantly, in the interim, FTA received assurance that various measures will be implemented to provide a level relief to current import service levels. Further detail will be provided as result of ongoing engagement and strategies are deployed.

Tariff Concession Orders (TCOs) are an effective tool to reduce customs duty where a free trade agreement is not available. However, where there is an objection from a local manufacturer, TCOs can be notoriously hard to obtain.

This may be about to change with recent case law suggesting the substitutable goods test has been incorrectly applied. In this webinar Russell Wiese of CGT Law will provide guidance on:

• The substitutability test and recent case law
• Key considerations for TCO applicants when drafting TCOs
• The requirement to make inquiries prior to lodging a TCO application
• Made to order goods and whether a local manufacturer is prepared to accept an order
