REPORTING SUSPICIOUS BEHAVIOUR TO THE ACCC
HAMBURG SUD RESPONSE TO FTA CONCERNS - SERVICING OF FREIGHT FORWARDERS
As outlined in last week's member notice, Hamburg Süd will restrict freight forwarding access as a part of revised arrangements effective 1 January 2022.

Freight & Trade Alliance (FTA) subsequently received advice from Hamburg Sud's Area Managing Director - Oceania outlining the rationale for reducing its focus on the freight forwarding sector- refer HERE (FTA/APSA MEMBER LOGIN REQUIRED)

FTA has again made contact with the Australian Competition and Consumer Commission (ACCC) who await further detail before assessing if there are any potential breaches of competition law, potential abuse of market power and to determine the consequences of such a significant market shift for Australia freight forwarders, importers and exporters.
THE ADBLUE 'CRISIS' IS MORE OF A WAKE-UP CALL
FTA/APSA representatives last week engaged direct with the Department of Infrastructure in terms of media reports pertaining to a limited supply of 'AdBlue' being the additive used in modern diesel engines to eliminate potentially harmful emissions in exhaust gasses and reduce air pollution.
This is one to certainly watch and a case of being vigilant and alert, rather than alarmed, as industry and government work together to deliver solutions. A highly commended commentary is provided by the Heavy Vehicle Industry Australia - READ MORE
US HOUSE PASSES OCEAN SHIPPING REFORM LEGISLATION
No issue about the need for disciplines such as storage and container detention but the 'fairness' of how it is is administered in Australia needs very close scrutiny and urgent reform. Interesting to read in JOC that the US House of Representatives overwhelmingly passed legislation that would upend how the United States regulates the container shipping industry.

"Shipper groups such as the National Retail Federation (NRF) and the Agriculture Transportation Coalition (AgTC) celebrated the passage of the bill, which would shift the burden of proof of the reasonableness of detention and demurrage to the carriers." READ MORE

WEBINAR - WEDNESDAY 15 DECEMBER 2021 (1030 PERTH TIME)
Join us for a one hour interactive webinar 10.30am Australian Western Standard Time (AWST) [1.30pm AEDT)  Wednesday 15 December 2021 to hear from Mills Oakley
The Western Australian government, more than any other, has introduced requirements for workers in multiple occupations to be vaccinated, including commercial transport, freight, logistics and port workers.

Whilst previously debates could be had about the feasibility, viability or even need for a business to require their workers to be vaccinated, these industries are now given no choice if they wish to continue operating lawfully.

Please join us to hear from Alexander Millman (Senior Associate - Workplace Relations, Employment and Safety) and Harold Downes (Partner - Workplace Relations, Employment and Safety).

A critical transfer point of intermodal trade is the marine container terminal; immense strain encountered globally through 2021 is set to continue through 2022.
