Clarifying statement – Trio charged over Australia’s largest onshore ice seizure

Wednesday, December 11, 2019

Further to yesterday's member notice disseminated by Susan Danks (Head of Customs and Regulatory Compliance – FTA / APSA), we are pleased to note the release of a "clarifying statement" by the ABF and AFP - refer HERE

"During a joint press conference on Thursday 5 December with Australian Border Force (ABF) and Australian Federal Police (AFP), comments were made in regard to the arrest of three people.

References were made that two of the people arrested were 'Customs agents' and 'Customs brokers'. These references were inaccurate.

Investigations are ongoing and no further comment will be made at this time."

Freight & Trade Alliance (FTA) has also followed up with media that published the "Customs agents" and "Customs broker" headlines for an editorial correction.

Obligations, risks and ethics

It is essential that the integrity of our sector of commerce is held in high regard and that those customs brokers that are members of FTA are recognised for completing the highest levels of ongoing professional development.

In support of this outcome, we are again delighted to advise that our 2020 CPD & CBC - Border and Biosecurity Compliance Program will include the following important sessions focused on "obligations, risks and ethics" as it specifically relates to the role of a licensed customs broker:

  1. Competition Law
  2. Privacy Act
  3. Consumer protection law (unfair contracts, false and misleading conduct etc) – noting that there has been a number of ACCC announcement and guidance since the unfair contract terms were extended to businesses.
