Putting aside how COVID-19 spread so quickly through metropolitan communities and whether or not restrictions should have lifted earlier, yesterday's zero cases is an amazing result well and truly worth celebrating.

We hope that yesterday's withdrawal of claims before the Fair Work Commission and agreement of no industrial action until 1 December 2020 will allow Patrick and the MUA enough time to sort out their differences and settle on an agreed Enterprise Agreement.
Whilst this provides much needed immediate relief, we also note concerns the industrial action last week at Hutchison Port Botany.
FTA / APSA remain committed to work with all industry colleagues to highlight economic impacts of ongoing industrial action. While our approach has at all times to take a collaborative approach with industry stakeholders, the action of many shipping lines continues to drive a wedge between us.
Adding salt into the wounds of a sector already suffering from a deep economic recession, some shipping lines remain unremain unrelenting in the imposition of congestion surcharges.
It remains frustrating that despite instances where shipping lines cannot provide a viable dehire option at their Sydney contracted facilities, the default position of many is to impose container detention penalties without taking into account the extreme circumstances.
The default position remains that you must accept detention invoices and if fortunate to battle your way past operational staff to shipping line executives, in some instances some relief has been experienced.
Why aren't all shipping lines more responsive to the situation and reviewing their default responses in the current operational environment?
The bottom line is that this has been caused by an imbalance of import / export container over the last 12 months exasperated by adverse weather conditions, industrial action (all 3 Port Botany terminals) and infrastructure / systems enhancements (by one terminal) combining to impact all shipping line contracted stevedores ... and yes Shipping Australia, these are "outraged howls of anguish" ... if not the shipping lines, who is responsible for managing this delicate balance of import / export containers that leaves us in this mess?
This is also translating to offshore shippers are seeing a severe lack of empty equipment available in China , India and SE Asia with some members reporting freight rates from US$2000-US$9000 per 20' with others are at risk of missing critical supply contracts examining limited and highly expensive air cargo options to supply on time.

SUSAN DANKS JOINS ICS TECHNICAL WORKING GROUP The Department of Home Affairs is establishing a technical working group to facilitate improved communication and collaboration amongst stakeholders on technical issues that affect interactions with the Integrated Cargo System. Commencing on Friday 30 October 2020, the working group will include representation from industry and government. CUSTOMS COMPLIANCE UPDATE The October 2020 Goods Compliance Update has been released by the ABF. Russell Wiese (Principal, Hunt & Hunt Lawyers) will provide commentary on the key customs compliance aspects of the report including:- compliance, audit and infringement notice trends;
- modern slavery reporting requirements for freight forwarders and customs brokers;
- expectations of customs brokers when completing declarations;
- customs broker licensing issues;
- subcontracting of customs brokerage services
Russell will also provide an update on the new dumping duty rates applying to Chinese aluminium extrusions and further guidance from the Anti-Dumping Commission as to what goods are covered by the dumping duties.
