WEEK IN REVIEW

 

ARE WE BEING SOFTENED UP FOR THE RE-INTRODUCTION OF CONGESTION SURCHARGES?

 

We note the commentary from the Shipping Australia Limited CEO in a recent Australian Financial Review article Maersk warns of delays as Australian strikes hit Asia-Pacific trade
 
Shipping Australia chief executive officer Melwyn Noronha said the resurgence of waterfront industrial action during a global pandemic was "grossly irresponsible and utterly inappropriate".
 
The delays experienced by Maersk and other shipping lines would be felt across the country given Australia's reliance on containerised goods. Mr Noronha said there would be increased costs for shippers and consignees, higher numbers of ports being skipped, and reduced frequency of shipping services
 
Further to our AITTIDF submission that failed to receive support from industry peers, SAL also confirmed late last week that they did not support this approach.

While neither the AITTIDF nor SAL have given any rationale for their decisions, we have reached out to see whether any alternate proactive measures are being initiated that we could support to reduce the risk of escalating industrial action - while we await feedback we hope that the above commentary is not simply setting us up for the re-introduction of shipping line imposed congestion surcharges - refer also to our commentary in the international publication The Loadstar Deja vu' in Australia's ports as terminals are hit by new round of strikes

FTA / APSA will continue to engage with stevedores and key stakeholders to keep members up to date on this important matter.

 

 

CONGRESS DISCUSSES FORCING LINERS TO ACCEPT US EXPORT CONTAINER BOOKINGS

 

We will certainly watch this development with interest ... US politicians are discussing action to force shipping lines to take all export container bookings. A Republican and a Democrat have proposed the concept to the US House Transportation & Infrastructure Committee, claiming exporters are being discriminated by shipping lines who are prioritising the movement of empty containers back to Asia rather than wait for American exporters - further detail HERE.

 

 

CYBER ATTACKS AND SECURITY BREACHES CONTINUE

 

Advice last week that yet another shipping line has fallen to a Cyber attack, emphasises the need to ensure your systems are as secure as they can be. With more and more work being performed off site and in employees homes the need to ensure the networks they access are secure is paramount. In a recent article in Across Borders, Jonathan Sharrock (CEO - Cyber Citadel) wrote on "Remote working habits in the COVID-19 environment"

 

Jonathan's article highlights the steps that can be taken to improve the security of your systems and also minimise the risk of cyber interventions. Cyber Citadel can also provide "penetration testing"  on your company's information systems 

Attempts are made to break into your systems using the same methods that a malicious hacker would employ. These could include exploiting unsecured or unpatched devices on your network, flaws in third-party software or human errors in systems configuration.

Penetration Tests are our specialty, and each is conducted using highly-trained experts and unique methodologies to combat the flaws inherent in automated scanners that some others use. 

 

 

AUSTRALIAN BORDER FORCE SYSTEMS OUTAGE

 

The following was received from ABF executives on 18 June 2021:

Yesterday the Department of Home Affairs – among numerous organisations – experienced issues as a direct result of a failure at one of our Service Providers

As a result, from approximately 13:50 yesterday, many external Cargo Interactive (CI) users were unable to access the ABF web site and/or certain systems/applications available from the web site, that included the Cargo Interactive (CI). 

The ICS itself was functioning normally and processing of EDI messaging was not impacted, although there may have been issues with delivery of EDI message payloads for some clients.

We understand full service was restored at around 18:15 or so yesterday evening.

FTA/APSA MEMBER ADVOCACY UPDATE ON SIMPLIFIED TRADE SYSTEM IMPLEMENTATION TASKFORCE

 

Further to our FTA/APSA MEMBER ADVOCACY UPDATE - CANBERRA 2 & 3 JUNE 2021 and our meeting with the Hon Dan Tehan (Minister for Trade, Tourism and Investment), we indicated that an update will soon be released in terms of a Simplified Trade System (STS).

FTA / APSA has since also met with Australian Border Force (ABF) representatives in a Canberra meeting examining opportunities for reform as a part of the 'Regulatory Sandbox' initiative.

Freight & Trade Alliance (FTA) has partnered with the WiseTech Academy to provide *cost-effective, high quality and easy to use e-learning accreditation to support compliance for staff working at licensed depots and Approved Arrangement facilities (*discounts apply for FTA members).

SECTION 77G DEPOT

Notice 2013/56 (condition 28) states Section 77G Deport licence holders must provide adequate training to make staff aware of their obligations in dealing with goods subject to the control of Customs.
CONTENT - the Section 77G Depots - Obligations Course provides operational staff with practical learning outcomes to be able to complete day to day activities with confidence that they are compliant with statutory requirements.
FREQUENCY - we recommended that staff complete this course at induction and at a minimum, review annually to remain up to date with regulatory requirements.
COST - $48 (further discounts apply for FTA members)

APPROVED ARRANGEMENTS

Approved Arrangements, previously known as Quarantine Approved Premises (QAPs) and Compliance Agreements, are voluntary arrangements entered into with the Department of Agriculture, Water and the Environment (the department).
These arrangements currently allow operators to manage biosecurity risks and/or perform the documentary assessment of goods in accordance with departmental requirements, using their own sites, facilities, equipment and people, and without constant supervision by the department and with occasional compliance monitoring or auditing.
CONTENT - to secure an Approved Arrangement (AA) accreditation, staff are required to undertake the prescribed training course containing the following two subjects:

  • Biosecurity Awareness - provides an introduction to biosecurity in Australia and prepares staff to recognise the biosecurity risks and how these are addressed by the key stakeholders, including the department.
  • Approved Arrangement Accreditation for AA Accredited Persons - provides the skills and knowledge required for staff to undertake their role as an Accredited Person within an AA - in this course, staff will be introduced to the requirements for Classes 1 to 8 and 10 to 14 AAs, and responsibilities in identifying and reducing biosecurity risks at AA sites.

FREQUENCY- We recommended that staff complete this course at induction and at a minimum, review annually to remain up to date with regulatory requirements.
