Commencement of Customs Amendment Bills - Licensing : REGISTER NOW FOR CPD AND DEPOT FORUMS

The Customs Amendment (Strengthening and Modernising Licensing and Other Measures) Act 2024, the Customs Licensing Charges Amendment Act 2024 and the Customs Amendment (Renewal of Warehouse Licences) Regulations 2025 (collectively known as the Customs Amendment Legislation) have come into effect yesterday, 5 March 2025.
 

OVERVIEW

The Customs Amendment Legislation has made a number of changes to existing legislation, including to:
  • modernise licence administration to allow electronic lodgement of applications (including variations and renewals) and sending of notices electronically for the customs licensing regime;
  • streamline the regulation of customs broker licensing by expanding nominee eligibility and expediting the disciplinary process for certain breaches, and streamlining cancellation notices;
  • strengthen the entry requirements to be eligible to hold a licence;
  • align and enhance the power to give directions in respect of warehouses and depots;
  • update the administration of licence renewals, suspensions and cancellations;
  • strengthen the licensing regime by bolstering fit and proper checks of licensed persons (both corporate and natural)
  • allow for digital claims for return of seized goods by providing the information required approved by the Comptroller-General of Customs;
  • permit the disclosure of AusCheck scheme personal information to an officer of Customs for the exercise of that officer's powers under the Customs Act 1901; and
  • allow the use of electronic documentation when seeking approval for the use of ship and aircraft stores before the departure of the ship or aircraft from its last port of departure.
