Consultation for Anti Dumping Commission form update

Freight & Trade Alliance (FTA) has received advice from the Anti-Dumping Commission regarding proposed updates to key application forms, part of a broader initiative to streamline processes and improve user experience across Australia's anti-dumping and countervailing framework.

As an active participant in the International Trade Remedies Forum (ITRF) — represented by Russell Wiese (Principal, CGT Law) — FTA contributes industry insight and stakeholder feedback to support the continuous improvement of trade remedies policy. This latest request for consultation reflects the Commission's commitment to transparency and better engagement with industry.

The Commission is now seeking targeted feedback from stakeholders on two proposed changes to ADC Form B108, the form used to apply for a dumping and/or countervailing duty notice:

  • Goods Description (Pages 9–10, Section A-4): Revised to assist applicants in accurately identifying the goods alleged to be dumped or subsidised. As this section defines the scope of an investigation and cannot be amended once proceedings begin, clarity and precision are essential.
  • Standing Questions (Page 9, Section A-3 and Appendix A1): A new question and supplementary details in the appendices are designed to ensure the application is supported by a sufficient portion of the Australian industry, a statutory requirement before an investigation can commence.

A summary of the proposed changes is outlined in the document titled "Table 1: Key Changes to Anti-Dumping Commission Form B108", with draft versions of the updated form and appendices also available. FTA invites interested members to review the proposed changes and provide feedback directly to Engagement@adcommission.gov.au by 26 May 2025.


New Pre-Application Support Service

As part of its broader reform agenda, the Commission has also introduced a pre-application service for industry participants considering a formal application under section 269TB(1) of the Customs Act 1901. This initiative allows for early engagement with the Commission to clarify requirements and improve the quality of applications. Further details are available in Anti-Dumping Notice 2024/036.
