Freight & Trade Alliance (FTA) has received advice that the former Anti-Dumping Commission has been renamed the Australian Trade Remedies Commission following commencement of the Customs Amendment (Safeguard Inquiries) Act 2026.
The change reflects an expansion of responsibilities, with the Australian Trade Remedies Commission now serving as Australia's central trade remedies authority responsible for: - anti-dumping investigations;
- countervailing investigations; and
- safeguard inquiries.
A significant aspect of the reform is the transfer of safeguard inquiry responsibilities from the Productivity Commission to the Australian Trade Remedies Commission, bringing Australia's trade remedies functions under a single specialist authority.
Safeguards are temporary measures that may be applied where increased imports are causing, or threatening to cause, serious injury to an Australian industry. These measures can include tariffs, quotas or tariff-rate quotas and are administered in accordance with Australia's international obligations.
For members currently dealing with anti-dumping or countervailing measures, day-to-day arrangements remain largely unchanged.
Existing investigations, notices, forms and systems will continue to operate while references to the Anti-Dumping Commission are progressively updated to reflect the Commission's new name and expanded role.
FTA welcomes the opportunity to continue engaging with the Australian Trade Remedies Commission through its consultative arrangements and bilateral engagement to ensure members' needs and experiences continue to be represented.
As part of that ongoing engagement, FTA will continue advocating for the establishment of a formal goods advice mechanism.
Members have consistently raised the need for greater certainty when determining whether specific products fall within the scope of trade remedy measures.
A practical advice process would provide businesses with timely guidance, support informed commercial decisions and reduce compliance uncertainty.
