INVESTIGATION 691

ALUMINIUM WINDOWS AND DOORS FROM THE PEOPLE'S REPUBLIC OF CHINA

Update 1 - Engagement and member feedback

Further to the publication of the Australian Trade Remedies Commission's (ATRC) preliminary findings in Investigation 691 – Aluminium Windows and Doors from the People's Republic of China, Freight & Trade Alliance (FTA) has received a significant number of member enquiries regarding the practical implications of the announced anti-dumping and countervailing securities.

The enquiries received to date have centred on a range of issues, including:

  • whether anti-dumping securities will apply to goods already shipped or currently on the water;
  • whether retrospective liabilities may arise for previously imported goods;
  • arrangements for "goods on water" consignments and access to applicable DSNs;
  • the practical process for lodging import declarations affected by the new securities;
  • requirements relating to security identifiers through NTIS and ICS processing;
  • eligibility for exemptions, exclusions, deferrals or alternative arrangements;
  • treatment of exporters that participated in the investigation but were not selected for detailed examination;
  • whether curtain wall products fall within or outside the scope of the investigation;
  • security rates applicable to particular suppliers and manufacturers;
  • the broader commercial impacts for affected importers and ongoing projects.

FTA has commenced direct engagement with senior ATRC representatives seeking clarification on these and other matters and has also engaged with legal counsel to assist in understanding the practical implications for members.

Given the level of industry interest, FTA understands that ATRC is also considering the release of additional guidance material and frequently asked questions to assist affected stakeholders.

At this stage, members are encouraged to review their current and forthcoming imports that may be affected by Investigation 691 and to identify any shipments currently in transit that may require further consideration depending on ATRC guidance.

FTA will continue discussions with ATRC and legal counsel and will provide updates as soon as further clarification becomes available.
